1 Introduction to our terms and conditions (the “Terms and Conditions”)
1.1 Please read these Terms and Conditions carefully before using the Website operated by The Friendly Collection Limited (Company Number 5721318).

1.2 By using or accessing the Website, you agree to be legally bound by these Terms and Conditions of use as they apply to your use of or access to the Website.

1.3 If you do not wish to be bound by these Terms and Conditions then you may not use the Website.

2 Buying Goods on the Website
2.1 The Website is a place for you to select and order goods (the "Goods").

2.2 To make an order please click on the item you require and you will be prompted to select the size and quantity and then add it to your shopping basket. Once you have finished selecting your items click "Order" where you will be asked for details to satisfy your order before your order is submitted.

2.3 We accept the following credit/debit cards for on-line payment: Visa; MasterCard; Maestro; Switch; Solo; JCB and Electron. Your card will not be debited until your order is ready to send.

2.4 All Goods are subject to availability and an order will not constitute an agreement on our part to sell the Goods to you until it is accepted by us. If your order is accepted we will confirm acceptance to you by electronic means ("Acceptance") to the e-mail address you have given us on ordering. You will be notified of Acceptance as soon as reasonably possible after your order has been received.

2.5 If you do not wish to make a payment on-line please proceed to the checkout, then select the option to print a copy of your order and send it, along with your cheque, made payable to The Friendly Collection Ltd., to PO BOX 68, York, YO61 1WD. Your order will be despatched once your cheque has cleared.

3 Specification of Goods
The Goods sold on the Website are materially in accordance with the description given on the Website but you must select the appropriate size/ colour/number/any other classification when placing your order.

4 Prices and Payment
4.1 The prices of the Goods are as specified on the Website. Prices may change and the applicable price is that shown on the day which your order is placed.

4.2 For all orders, the prices are inclusive of UK VAT at the standard rate - currently 15%. Our VAT Registration Number is: 894 8935 45.

5 Delivery
5.1 Irrespective of the number of items ordered, the delivery charges are:

UK Standard (Royal Mail 2nd Class) £1.95

European Union countries (airmail) £2.95

Rest of the world countries (airmail) £3.95

Please note: The prices shown above represent a 50% discount on the standard delivery prices of £3.95, £5.95 and £7.95 respectively.  The discount was introduced on 29th June 2008 and will run for an indefinite period, but at least until 31st August 2008.

5.2 Subject to the availability of stock, we aim to despatch the Goods within three working days of Acceptance for standard delivery. Delivery of the Goods will be made to the address shown in your order.

5.3 Whilst we aim to despatch the Goods according to the above timescale, we cannot accept responsibility for items delayed whilst in the care of the postal services.

5.4 Unless we are notified by e mail or otherwise in writing within 7 days of the date of delivery of the Goods they will be deemed to have been received by you undamaged and in good order.

6 Out of Stock Items and Substitution of Goods
6.1 If any of our Goods are marked "out of stock" you may still place an order. We will notify you when it becomes available and you may either proceed with your order or cancel it.

6.2 We may offer alternate Goods to you in substitution for those that are out of stock. We will not substitute any Goods unless you expressly agree to this in writing by letter, fax or e-mail.

7 Your Right to Cancel
You have the right to cancel your order in respect of the Goods you order within 7 days of the date of delivery of the order to you. To cancel your order you should notify us within that period and then, at your own cost, return the Goods to us at the address given at the end of these Terms and Conditions as soon as reasonably possible. Please note that we cannot accept returns of any goods which have been used or had their cover broken.

While in your possession, you must keep any Goods you intend to return is us in good condition.

8 Quality
We give you the warranty that all Goods will, in all material respects, comply with the description given of them on the Website and that they will be of satisfactory quality and fit for the purpose for which they are indicated on the Website. Except for the foregoing warranty no other warranty for the Goods is given.

9 Returns Policy
We at The Friendly Collection Limited take great care to ensure that all Goods we sell are of high quality. Should you be unhappy with our Goods you can, upon giving us an explanation of your complaint, return the unused portion of the product in its original packaging. On receipt we will refund of the purchase price provided that each item is returned within 30 days of the delivery of the Goods to you. Your rights against us shall be limited to your rights to the return of your money. This does not affect your statutory rights.

10 Intellectual Property Rights
All material on the Website is covered by international copyright laws and other intellectual property rights. You may not modify, copy, reproduce, republish, upload or retransmit any material from the Website including but not limited to text, graphics, video, messages without our prior written consent apart from downloading the order form or other pages for your own personal use.

11 General Provisions
11.1 We may alter these Terms and Conditions from time to time and post the new version on the Website and that version will take effect immediately thereafter. You must check these Terms and Conditions on the Website regularly.

11.2 These Terms and Conditions include and incorporate our privacy policy.

11.3 If any provision of these Terms and Conditions shall become illegal or unenforceable for any reason whatsoever then these Terms and Conditions shall take effect as if such provision had been omitted and the remainder of the Terms and Conditions shall not be affected.

11.4 These Terms and Conditions and your use of the Website are governed by English law and you submit to the non exclusive jurisdiction of the English court.

11.5 Failure by either party to exercise any right or remedy under this agreement does not constitute a waiver of that right or remedy.

12 Notices
12.1 All notices shall be given to us:

(a) by pre-paid recorded delivery or registered post to Arabesque House, Monks Cross Drive, Huntington, York, YO32 9GW;

(b) by e-mail to a ‘read receipt’ should be requested;

(c) by fax to +44 (0) 1347 838 425;
and to you at either the e-mail or the postal address you provide on your order form.

12.2 Any notice given under these Terms and Conditions shall be deemed to have been received:

(a) if delivered personally, at the time or delivery;

(b) in the case of pre-paid recorded delivery or registered post, 48 hours from the date of posting;

(c) in the case of registered airmail, five days from the date of posting; and

(d) in the case of fax or email, at the time of transmission.

12.3 If deemed receipt occurs after 5pm on a Business Day or on a day that is not a Business Day then the notice shall be deemed to have been received at 9am on the next Business Day.

12.4 For the purposes of this clause a Business Day shall mean any day which is not a Saturday, a Sunday or a bank or public holiday in England.
